Apple Samsung Patent Retrial Starts on Tuesday

Apple and its archrival Samsung have locked horns on many matters. Most of them have to do with issues over patent copyright infringement. And yet again Apple is all ready to face Samsung once again in patent retrial of the century starts this Tuesday.

Apple laid claim to $400 million in damages from Samsung. The trial is about to begin. But this is just the tip of the iceberg. The remaining $600 million are still pending. That is because the original amount of cash that Apple was to be awarded was more than a billion dollars.

The major hindrance in decision making was the complex mathematical and legal calculations involved in the process. That took up quite some time. Samsung was busy at its end claiming reparations for damages. So, Apple used a methodology that cut the Gordian knot. It simply handed in the single page form that was required by the jury.

Samsung had been using delaying tactics but they failed in the end. The pre-trial events went in favor of Apple. A third trial will also be attended by both parties to the dispute in March of next year. The bone of contention is the Galaxy S3. The S4 has been spared though.

Apple’s luck has been steadily improving of late. It also won a stay order against a lawsuit brought against it by Google. Apple is challenging the Android ecosystem alright. It’s a fact of life that big business involves some hard and fast rules that need to be negotiated with a tough upper lip. And sometimes recourse to the law is a must too.
