Apple is not allowed to use refurbished iPhones as service replacements in Denmark

Apple is known for its after sales services and support. Many people praise the company’s device guarantee policy and Care Programs. The Cupertino Company has done a great deal in its international repair and replacement program. If you have ever found yourself in a situation abroad where your phone requires attention your nearest Apple store can take care of all your problems in no time.

However you will be surprised to know that Apple sometimes just hands you over a refurbished replacement unit. Many of the users find out later in one way or another. This also happened with David Lysgaard in Denmark in 2011. He got a replacement iPhone 4 in August and was very upset when he found out that it was not a new one. His reaction was so much that he actually filed a law suit.

Now after a good four years the Danish court has ruled in favorq of David and has banned Apple from selling refurbished units as replacements in the future. The court stated the Danish Sale of Goods Act and explained that resell value and the refurbished unit value does not match.

This argument sounds logical on paper and it is undeniable that two iPhone’s cannot cost the same but it is also true that Apple will rarely be in a situation where it will replace unspoiled new units for refurbished ones.

It is more than often that users give in a somewhat damaged device and are replaced with a better phone. In addition Apple also guarantees the internal components after a thorough check. Then again no matter how many status checks are made if a refurbished device in question is offered on direct sale by Apple the price will certainly be affected by their second hand nature.

This is a valid point but the Cupertino Company reserves a right to appeal.
