Kelly Rutherford the star of Gossip Girl will be receiving sole legal and physical custody of her two children.
Kelly Rutherford’s children have been living with their father and Rutherford’s ex-husband Daniel Giersch in Monaco since 2012. A California court has ordered Giersch to return 8 years old son Hermes and 6 years old daughter Helena to the Unite d States.

The Gossip Girl star will be the sole legal and physical guardian until a hearing scheduled for June 15th in an L.A. superior court. Giersch visa had been revoked in 2012 due to his alleged illegal activities in the States and a California judge ruled since Giersch will not be able to visit his children in US, Rutherford will have to go visit the children in Monaco even though they shared custody.
Giersch never reapplied for a visa to the States and Rutherford has been fighting over the custody since then. However recently Rutherford revealed after she arrived in France for her latest trip Giersch did not allow her to see her kids and asked her to hand over the children’s passports to his attorney.
According to Rutherford’s legal team head Wendy Murphy they are very happy following the recent ruling and hope the officials in Monaco will respect the California laws as the children are not actually citizens of Monaco but US citizens.
Murphy also claimed Monaco officials know sending the children to the US are the right thing to do and is looking forward to the children’s reunion with their mother and home country, according to People magazine.

Rutherford was three months pregnant with her daughter Helena when she filed for divorce in 2009 but claims she has always wanted her children to have a relationship with their father but what happened over the previous six years in custody battles is the most bizarre time of her life.
