According to Bloomberg, Apple won two patent infringement claims against HTC Android Phones. This could be really bad news for Android in general. Microsoft is already milking Android makers for licensing fees and now Apple could actually destroy Android through patent litigation.
This is all about these nasty field of software patents. Software patents are long claimed to be poison for software innovation. For Android this could become a very real poisoning. Florian Mueller at Foss Patents is diving knee deep into what Apple patents have won in a first step against HTC. These patents are pretty general and do not apply just for HTC, but Android in general. Read this initial report and then this very in-depth analysis here. The LA Times points out that the patents in question have been long filed before there have been smartphones, but I do not think that matters much. Patents are all about the future. This is why they make it so hard to establish a new innovation.
HTC has issued an official response to the ITC ruling. “We are highly confident we have a strong case for the ITC appeals process and are fully prepared to defend ourselves using all means possible,” said Grace Lei, General Counsel of HTC. “We strongly believe we have alternate solutions in place for the issues raised by Apple. We look forward to resolving this case, so we can continue creating the most innovative mobile experiences for consumers.”
HTC also points out that Apple is infringing on a patent of S3 Graphics according to an ITC ruling. HTC bought S3 Graphics just recently on July 6. Now we maybe know why the bought S3 in the first place, hint: Patents.
